Registering a Divorce
To register in Italy a divorce judgment issued in Australia, the Consular Office must receive:
- A self-declaration in lieu of a sworn statement (dichiarazione sostitutiva di atto di notorietà), dated and signed by the Italian citizen.
- The original Decree Absolute of Divorce (or Decree Nisi) or Divorce Order certificate, legalized by means of an apostille (issued by the Department of Foreign Affairs and Trade).
- An Italian translation of the document, carried out by an accredited NAATI translator.
Please note that translation of the apostille is NOT required.
- A photocopy of the Italian identity card or Italian passport of the Italian citizen(s), and a photocopy of the passport of the foreign citizen (if the parties involved are not both Italian).
To register a divorce judgment issued by a country other than Australia, this Office must receive:
- A self-declaration in lieu of a sworn statement, dated and signed by the Italian citizen.
- The original divorce judgment issued by the competent authority of the country, legalized according to the procedures required by that country.
- An Italian translation of the judgment, carried out by a professional translator and legalized/certified according to the procedures required by that country.
Please note that translation of the apostille is NOT required.
- A photocopy of the Italian identity card or Italian passport of the Italian citizen(s), and a photocopy of the passport of the foreign citizen (if the parties involved are not both Italian).
The above-mentioned documentation may be sent by post or delivered in person at this Consulate during public opening hours, without the need for an appointment.
