Marriage in Italy for Australian

Australian citizens who intend to marry in Italy will have to present a document called “ATTO NOTORIO” (notarial deed) to their Embassy or Consulate in Italy in order to obtain a “nulla osta” (no impediment certificate) which then needs to be presented to the town hall where the wedding will be celebrated. The “ATTO NOTORIO” is valid for 6 months from the date of issue.

If one of the two applicants is not an Australian, the documents listed above are only required for the Australian side but both bride and groom must be present at the appointment along with 4 witnesses.

If both applicants are also citizens of a European Union country, the ATTO NOTORIO is not required.

    ATTO NOTORIO

    Australian citizens who wish to get married in Italy, need to obtain a NULLA OSTA (authorization) which has to be presented before the celebration to the "Comune" where the wedding is taking place (two different documents will be necessary if both future spouses have Australian citizenship).

    In order to obtain the above NULLA OSTA (authorization) it is necessary to prepare the ATTO NOTORIO, which is to be signed by the Australian who is getting married along with four (4) witnesses and in which it is declared that there are no impediments to the marriage, (articles 95, 86, 89 and 97 of the Italian Civil Code). The Atto Notorio is valid for 6 months and for this reason it must be requested no earlier than 6 months from the date of celebration of the marriage.

    The Atto Notorio can be obtained:

    • In Australia, at our Consulate in Brisbane if resident in Queensland and Northern Territory; 
    • In Italy: at any Tribunal or Local Court.

    Once obtained, the ATTO NOTORIO will have to be presented to the Australian diplomatic/consular authorities in Italy (Australian Embassy in Rome), which will grant the NULLA OSTA, pursuant to article 116 of the Italian Civil Code.

    HOW TO OBTAIN THE ATTO NOTORIO

    In order to obtain the atto notorio at the Consulate of Italy in Brisbane (residents in Queensland or N.T.), the applicants must book an appointment via email to notarile.brisbane@esteri.it and provide, all the required information and personal details listed in the attachment (app form ATTO NOTORIO BRIDE  - app form ATTO NOTORIO GROOM).

    TO BE NOTICED:

    • The applicants and the 4 witnesses must be all present on the day of the appointment at this Consulate of Italy in Brisbane;
    • The four witnesses must not be related to bride and groom, but they can be related between them;
    • If both bride and groom are Australian citizens, they will need to sign an ATTO NOTORIO each. Bride and groom can use the same witnesses;
    • For the procedures to be followed in Italy, please visit the website of the Australian Embassy in Rome.
    • Together with the Atto Notorio, Australian citizens who wish to get married in Italy need to provide the Italian City Council with:
      • Birth certificate in original and related official translation into Italian (NAATI), both bearing the Apostille, granted by the Department of Foreign Affairs and Trade
      • Single Status Certificate in original (issued by the Registry of Births, Deaths and Marriages) and related official translation into Italian (NAATI), both bearing the Apostille, granted by the Department of Foreign Affairs and Trade.
