The atto notorio is valid for 6 months from the date of issue.<\/p>\n<p>If one of the two applicants is not an Australian citizen, the documents listed above are required only for the Australian party; however, both parties intending to marry must still be present at the appointment and must in any case be accompanied by 4 witnesses.<\/p>\n<p>If both applicants also hold citizenship of a European Union country, the atto notorio is not required.<\/p>\n<p><strong>Atto Notorio<\/strong><\/p>\n<p>An Australian citizen who decides to marry in Italy will need the document called the atto notorio (two separate documents will be required if both future spouses hold Australian citizenship). This document, which declares that there is no impediment to the marriage (pursuant to Articles 95, 86, 89 and 97 of the Italian Civil Code), must be signed by the applicant and by four (4) witnesses.<\/p>\n<p>The atto notorio is valid for 6 months, and for this reason it should not be requested more than 6 months before the date of the marriage.<\/p>\n<p>The atto notorio can be obtained:<\/p>\n<ul>\n<li>In Australia, at the Consulate, for residents of Queensland and the Northern Territory.<\/li>\n<li>In Italy, at a Court (Tribunale).<\/li>\n<\/ul>\n<p>Once obtained, the atto notorio must be submitted to the Australian diplomatic-consular authorities in Italy (by the Australian Embassy), which will issue the Nulla Osta pursuant to Article 116 of the Civil Code.<\/p>\n<p><strong>How to Obtain Atto Notorio<\/strong><\/p>\n<p>To obtain the atto notorio at the Consulate of Italy in Brisbane, applicants residing in Queensland and the Northern Territory must book an appointment by email at\u00a0<a href=\"mailto:notarile.brisbane@esteri.it\">notarile.brisbane@esteri.it<\/a>\u00a0and submit the following forms:<\/p>\n<ul>\n<li><a href=\"https:\/\/consbrisbane.esteri.it\/wp-content\/uploads\/2023\/08\/atto-notorio-SPOSA-BRIDE.doc\">ATTO NOTORIO \u2013 BRIDE form<\/a><\/li>\n<li><a href=\"https:\/\/consbrisbane.esteri.it\/wp-content\/uploads\/2023\/08\/atto-notorio-SPOSO-GROOM.doc\">ATTO NOTORIO \u2013 GROOM form<\/a><\/li>\n<\/ul>\n<p>The applicants and the 4 witnesses must be present on the day of the appointment.<\/p>\n<p>The 4 witnesses must not be related to the couple, but they may be related to one another.<\/p>\n<p>If both spouses are Australian citizens, they may use the same witnesses, and two separate atti notori must be signed (one for the bride and one for the groom).<\/p>\n<p>For the procedures to be carried out in Italy, please refer to the information provided on the website of the Australian Embassy in Rome (<a href=\"https:\/\/italy.embassy.gov.au\/rome\/769.html\">https:\/\/italy.embassy.gov.au\/rome\/769.html<\/a>).<\/p>\n<p>Australian citizens wishing to marry in Italy will need the following documents, which must be submitted to the Italian Comune where the wedding will take place, together with the atto notorio:<\/p>\n<ul>\n<li>Original birth certificate and its official Italian translation (NAATI), both bearing an apostille issued by the Department of Foreign Affairs and Trade (for Australia).<\/li>\n<li>Single Status Certificate (issued by the Registry of Births, Deaths and Marriages) and its official Italian translation (NAATI), both bearing an apostille issued by the Department of Foreign Affairs and Trade.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"Australian citizens intending to marry in Italy must submit to their Embassy or Consulate in Italy a document called an\u00a0atto notorio\u00a0(sworn declaration) in order to obtain the &#8220;nulla osta&#8221; (no-impediment certificate), which must then be submitted to the Municipality (Comune) where the marriage will take place.
