{"id":8038,"date":"2026-09-14T13:20:04","date_gmt":"2026-09-14T11:20:04","guid":{"rendered":"https:\/\/consbrisbane.esteri.it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/registrazione-degli-atti-di-nascita\/"},"modified":"2026-09-14T13:38:54","modified_gmt":"2026-09-14T11:38:54","slug":"registrazione-degli-atti-di-nascita","status":"publish","type":"page","link":"https:\/\/consbrisbane.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/registrazione-degli-atti-di-nascita\/","title":{"rendered":"Births"},"content":{"rendered":"<p>The request <strong>to register in Italy the birth abroad of a minor child<\/strong> (i.e., under 18 years of age) of an Italian citizen constitutes an application for recognition of citizenship on behalf of the minor.<\/p>\n<p>Italian citizenship is transmitted from parent to child, for a maximum of two generations, provided that the Italian parent has never renounced their citizenship.<\/p>\n<p>Under the provisions of Decree-Law No. 36\/2025 of 28 March 2025, converted into law on 24 May 2025 (Law 74\/2025), an Italian citizen automatically transmits citizenship to a minor child born abroad \u2014 and can therefore register the birth in Italy \u2014 if one of the following conditions applies:<\/p>\n<ul>\n<li>A parent (including an adoptive parent) or a grandparent holds \u2014 or must have held at the time of death \u2014 exclusively Italian citizenship (i.e., does not and cannot hold any citizenship other than Italian) at the time of the minor&#8217;s birth.<\/li>\n<li>An Italian parent (including an adoptive parent), holding another citizenship at the time of the minor&#8217;s birth, was resident in Italy for at least two continuous years after acquiring Italian citizenship and before the birth or adoption of the minor.<\/li>\n<li>The minor does not hold and cannot hold any other citizenship.<\/li>\n<\/ul>\n<p>To register the birth of a minor that occurred in Australia, the following must be submitted:<\/p>\n<ol>\n<li>The request for transcription of the minor&#8217;s birth.<\/li>\n<li>The original birth certificate, issued by the Registry of Births, Deaths and Marriages, legalized by means of an apostille (issued by the Department of Foreign Affairs and Trade).<\/li>\n<li>The Italian translation of the birth certificate, carried out either by an official NAATI translator or independently. If you choose to translate it independently, please note that the translation must fully conform to the original text. If this Office finds discrepancies with the English text or missing elements, all documentation will be returned to the applicant for correction. Please note that translation of the apostille is NOT required.<\/li>\n<li>Photocopies of the parents&#8217; passports.<\/li>\n<li>If the parents held only Italian citizenship at the time of the birth, or if a parent was resident in Italy for two continuous years, a historical residency certificate to be requested from the Italian Comune.<\/li>\n<li>If a grandparent held exclusively Italian citizenship at the time of the minor&#8217;s birth, a certificate of non-naturalization to be requested from the competent authorities.<\/li>\n<\/ol>\n<p>The above-mentioned documentation must be delivered in person at this Consulate during public opening hours, without the need for an appointment, or sent by post to the Consulate of Italy in Brisbane, Level 8, 199 George Street, Brisbane City, QLD, 4000.<\/p>\n<p>For minor children born in a foreign country other than Australia, please contact the Consular Office.<\/p>\n<p>A further case is governed by paragraph 1-bis of Article 4 of Law No. 91\/1992 and by Article 1-ter of Decree-Law No. 36\/2025, which establishes the acquisition of citizenship by a minor through <a href=\"https:\/\/consbrisbane.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/citizenship-new-web-section\/acquisition-of-citizenship-by-benefit-of-law-minor-children-born-abroad\/\">&#8220;benefit of law&#8221;<\/a>.<\/p>\n<p>The Comune may refuse to transcribe the birth of a minor born during a marriage if the parents&#8217; marriage has not yet been registered. Applicants are therefore urged to submit the documentation relating to their marriage together with the documentation for the transcription of the minor&#8217;s birth.<\/p>\n<p>The registration of the birth of minors adopted abroad follows a different procedure. Please contact the Consular Office at <a href=\"mailto:brisbane.statocivile@esteri.it\">brisbane.statocivile@esteri.it<\/a>.<\/p>\n<p>Once the appointment at the Consular Offices has taken place, the registration is to be considered successfully completed.
