Constitutional Referendum, December 4, 2016

The Presidential Decree published on Gazzetta Ufficiale no. 227 on 28 September 2016, called for a Constitutional Referendum to be held on 4Th December 2016. This is the question voters are asked to answer: “Approvate il testo della legge costituzionale concernente “disposizioni per il superamento del bicameralismo paritario, la riduzione del numero dei parlamentari, il contenimento dei costi di funzionamento delle istituzioni, la soppressione del CNEL e la revisione del titolo V della parte II della Costituzione” approvato dal Parlamento e pubblicato nella Gazzetta Ufficiale no. 88 del 15 aprile 2016?”
Please note, the electoral papers will be in Italian only. The following is a courtesy translation in English (made by the Consulate of Italy in Brisbane) to assist non-Italian speakers. However, each voter is responsible for their own interpretation and/or research, in order to make their vote accurately express their will: “Do you approve the constitutional bill concerning the dispositions to overcome the perfect bicameralism, the reduction of the number of members of the Parliament, the restraint of the institutions' operating costs, the abolition of CNEL and the revision of Titolo V of the 2nd part of the Constitution, which was approved by the Parliament and published on the Gazzetta Ufficiale no. 88, on April 15, 2016?”

Italian voters residing abroad and registered in AIRE lists
Italian voters residing abroad and registered in AIRE lists (Registry of Italians living abroad) will receive their electoral kit at their recorded address. Should the voter fail to receive it, they may request a duplicate to their nearest Consular post. We shall remind all voters that it is their own responsibility as Italian citizens to keep their contact details and residential address up to date with the CONSULATE where they are registered.
Those who are listed in AIRE, yet wish to vote in Italy, can submit a specific declaration (see attached facsimile) to their closest CONSULAR MISSION (i.e. Embassy or Consulate), that shall be drafted on plain paper and have the declarant’s: first name, last name, date and place of birth, residential address, Italian Comune of origin, as well as the details of the electoral call that the voter would like to vote for.
The declaration must be duly dated and signed by the voter, and accompanied by a copy of their ID. It can be posted, faxed, emailed or hand delivered to the relevant CONSULAR POST, even by a third party, within 10 (ten) days from the publishing of the Presidential Decree on the Gazzetta Ufficiale. Voters have the possibility to withdraw their request within the same timeframe.

Italian voters temporarily abroad


Italian voters temporarily abroad for work, study or medical reasons who reside overseas for at least three months during the Referendum, as well as their family members living with them at the time, may opt for the absentee ballot, as organized by the Italian Consulates worldwide (law 459, 27/12/2001, ref. 1, art. 4-bis).
In order to be allowed to vote by absentee ballot, the voters shall submit a specific request to their own Comune in Italy, within 10 (ten) days from the publishing of the Presidential Decree on the Gazzetta Ufficiale (therefore by October 8th, 2016). Voters have the possibility to withdraw their request within the same timeframe. Please remember that the request is only valid for the current electoral call (i.e. the Constitutional Referendum on 4th December, 2016).
The request form (see attached facsimile) can be posted, faxed, emailed or hand delivered to the relevant Comune, even by a third party (please see www.indicepa.gov.it for the certified email addresses of Italian Municipalities).
The declaration, to be drafted on plain paper, must necessarily be accompanied by the declarant’s copy of ID. Furthermore, it must have the postal address where the electoral roll shall be sent to, as well as the indication of the relevant Italian Consulate and a declaration stating the possession of the right to vote by absent ballot (i.e. stating the voter is/will be abroad for work, study or medical reasons for at least three months during the time when the referendum will take place; or declaring to be part of the household of a citizen in the above mentioned condition).
The declaration shall be made according to articles 46 and 47 of Presidential Decree no.445 of 28/12/2000 (Consolidated text of laws and regulations relating to administrative documentation) and specify that the voter is aware that falsification of documents and untrue declarations are punished, in accordance with the penal code and with the special laws regarding the matter(as per the provisions referred to in the art. 76 of the above mentioned Presidential Decree 445/2000).
